You are prohibited from using the site for any unlawful purpose, to violate any regulations or laws, to infringe upon intellectual property rights, to submit false information, to upload malicious code, to collect personal information of others, or to interfere with the security features of the Service.

SECTION 13 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The Service and all products delivered to you are provided "as is" and "as available" without any warranties of any kind, either express or implied.

In no case shall Hiflow, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any of the Service or any products procured using the Service.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or in connection with these Terms will not exceed the amount you paid for the specific product to which the claim relates.

SECTION 14 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Hiflow and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 15 — SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be severed and shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 — TERMINATION

These Terms are effective unless and until terminated by either you or us. We may terminate this agreement at any time without notice if you fail to comply with any term or provision of these Terms.

SECTION 17 — GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provision.

Notwithstanding the foregoing, California residents retain all rights available to them under California consumer protection law, including without limitation the Consumer Legal Remedies Act, the False Advertising Law, and the Unfair Competition Law.

SECTION 18 — DISPUTE RESOLUTION AND BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

A. Informal Resolution First

Before filing any formal legal claim against Hiflow, you agree to contact us at info@hiflowgum.com and provide a written description of the dispute, the specific relief sought, and your contact information. You agree to attempt to resolve the dispute informally by giving us 30 days to respond before initiating arbitration or any other formal legal proceeding.

B. Binding Individual Arbitration

If informal resolution is unsuccessful, you and Hiflow agree that any dispute, claim, or controversy arising out of or relating to these Terms or the purchase of any products shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

Arbitration shall be conducted via telephone, videoconference, or other remote means, unless both parties agree in writing to an in-person hearing.

C. CLASS ACTION WAIVER

YOU AND HIFLOW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING.

THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

If a court finds that applicable law precludes enforcement of any of this subsection's limitations as to a particular claim, then that claim must be severed from arbitration and may be brought in court. All other claims shall remain subject to arbitration on an individual basis.

D. Public Injunctive Relief

Nothing in this Section prevents you from seeking public injunctive relief in court as permitted under California law where such relief cannot lawfully be waived. Any claim for individual monetary relief or damages remains subject to individual arbitration.

E. Waiver of Jury Trial

BY AGREEING TO THESE TERMS, YOU AND HIFLOW EACH WAIVE THE RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY CLAIM WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT.

F. Exceptions

Either party may seek emergency injunctive relief in court to prevent irreparable harm pending arbitration. Either party may also bring claims in small claims court that qualify for that court's jurisdiction on an individual basis.

G. Costs of Arbitration

For claims of $10,000 or less, Hiflow will pay all AAA filing, administration, and arbitrator fees unless the arbitrator finds your claim frivolous or brought for an improper purpose.

H. 30-Day Right to Opt Out

YOU HAVE THE RIGHT TO OPT OUT OF AND NOT BE BOUND BY THE ARBITRATION AND CLASS ACTION WAIVER PROVISIONS SET FORTH IN THIS SECTION.

To opt out, send written notice to info@hiflowgum.com with the subject line "ARBITRATION OPT OUT" within 30 days of your first purchase from our website or within 30 days of the effective date of these Terms, whichever is later. Your notice must include your full name, email address, and a clear statement that you wish to opt out.

I. Severability

If any portion of this Section 18 is found to be void or unenforceable, that portion shall be severed. The remainder of this Section shall continue in full force and effect.

J. Survival

This Section 18 shall survive any termination of these Terms or your use of the Services.

SECTION 19 — CHANGES TO TERMS OF SERVICE

We reserve the right to update or replace any part of these Terms at any time by posting updates on our website. Your continued use of the website following any changes constitutes acceptance of those changes.
